1. Acceptance of Terms
By downloading, installing, or using Fyx, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.
2. Acceptable Use & Fair Use Policy
Fyx is designed to enhance human productivity. To provide high service quality and protect our infrastructure from abuse, we enforce the following Fair Use Policy across all tiers:
- Personal License: Each account is license for a single human user. Sharing account credentials or allowing multiple people to use a single "Pro" subscription is strictly prohibited.
- Usage Caps: While "Pro" provides unlimited voice-to-text for standard personal or professional use, a soft cap of 20 hours of processed audio or 1,000 captures per month applies. Users approaching these limits will be notified.
- No Automation: You may not use scripts, bots, or automated tools to process audio through Fyx. "Scraping" or high-frequency automated dictation is grounds for immediate suspension.
- Business Integrity: If your usage patterns consistently exceed these "Fair Use" thresholds, we may reach out to transition you to a Team or Enterprise plan better suited to your scale.
- Right to Restrict: We reserve the right to throttle, suspend, or terminate access for any user who violates these terms or creates an undue burden on our systems.
3. Subscriptions & Billing
Fyx offers free and paid subscription plans.
- Free Tier: Includes 100 transcriptions per month with a 60-second limit per capture.
- Pro Tier: Offers unlimited transcriptions (subject to Fair Use) and custom preset features.
- Cancellations: You can cancel your subscription at any time via your account settings. Payments are non-refundable unless required by law.
4. Intellectual Property
All software, design, and branding associated with Fyx remain the exclusive property of Fyx. Your "polished" text is yours; we do not claim ownership over the content you generate using the tool.
5. Limitation of Liability
Fyx is provided "as is." We are not liable for any damages resulting from the use or inability to use the software, including but not limited to data loss or inaccuracies in transcription.
6. Governing Law
These terms are governed by the laws of the jurisdiction in which Fyx operates, without regard to conflict of law principles.
